Acceptance of these terms

These Terms of Service and Sale (“Terms”) apply when you use the Bassurito website or buy Bassurito from OAKWYN CORP. (“we”, “us”).

By using the site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the site or buy the product.

Bassurito is offered to customers in the United States. You must be at least 16, and old enough to enter a contract where you live.

How we handle personal information, including consent-based analytics and advertising cookies, is described in our Privacy Policy and Cookie & Storage Policy.

The product

Bassurito is a Max for Live MIDI Effect, supplied as a single .amxd file. It generates bassline MIDI patterns inside Ableton Live.

The free in-browser demo on our website is a preview. It runs locally in your browser. It may not match every feature of the device.

Price and taxes

Bassurito costs $49 USD as a one-time purchase. There is no subscription.

Your purchase includes free lifetime updates to Bassurito (see Updates).

All sales are final. See our Refund Policy.

Sales tax, VAT or GST may be added at checkout depending on where you live. The final price is shown before you pay. We may change prices for future purchases. A price change never affects an order you have already placed.

Orders and payment

Orders are processed by Polar (polar.sh), our merchant of record. Polar is the seller of record for your purchase. It handles payment processing (through its payment processor, Stripe), taxes (VAT / sales tax) and receipts, and hosts the checkout and the file download. Your purchase is also subject to Polar’s terms of service and privacy policy.

All sales are final. No refunds or returns, except where the law requires (see the Refund Policy). At checkout you must tick a required box confirming that you consent to immediate delivery, that all sales are final, and (where applicable) that you lose any right of withdrawal once delivery begins.

If you have a problem, contact us first. Filing a chargeback instead of contacting us may result in your license being revoked.

We do not see or store your card details. A contract is formed when you receive the order confirmation email.

We may refuse or cancel an order in cases of suspected fraud or an obvious pricing error. If we cancel, you get a full refund of the amount paid.

Digital delivery

Bassurito is delivered instantly by download link after payment through Polar. Your download access is in your purchase email and in the Polar customer portal. No license key is required.

Nothing physical is shipped. If your link does not arrive or stops working, contact support@bassurito.com and we will resend it.

Updates

Your purchase includes free lifetime updates, meaning free updates for as long as OAKWYN CORP. offers and supports Bassurito. It does not mean your lifetime or ours. Updates are delivered through your original download link or the Polar customer portal.

We may discontinue the product. If we do, we will give reasonable notice by email to buyers and on this website. You may keep using the last version you downloaded under the License.

Updates are covered by the same License Agreement. Updates may fix bugs, change features, or require newer versions of Ableton Live or Max.

Your license

You are buying a license to use Bassurito, not the software itself. The Software License Agreement (EULA) sets out what you may and may not do. It forms part of these Terms.

Your music and the MIDI you generate

You own the MIDI patterns you create with Bassurito. You may use them, edit them, and release them in your own music — commercial or not — royalty-free, commercially, without giving credit. We claim no share of your music.

This applies to MIDI output and the music you make with it. It does not let you redistribute Bassurito itself, or bulk-export its output to build a competing product or pattern library (see the License).

OAKWYN CORP. keeps ownership of the Bassurito engine, the device, and its underlying data and software.

Acceptable use of the website

Please don’t:

  • Try to break, overload or gain unauthorised access to the site.
  • Scrape or copy the site’s code, demo engine, text or design for reuse.
  • Sign up with someone else’s email or abuse the discount offer.
  • Use the site for anything unlawful.

Intellectual property

Bassurito, its code, sound design logic, pattern data, name, logo, website and content belong to OAKWYN CORP. or its licensors. They are protected by copyright, trademark and other laws.

Except for the rights in the License and your rights in your own output, nothing in these Terms transfers any ownership to you.

Third-party trademarks

Ableton, Ableton Live and Max for Live are trademarks of Ableton AG. Max is a trademark of Cycling ’74.

Bassurito is an independent product. It is not affiliated with, sponsored by or endorsed by Ableton AG or Cycling ’74. We use their names only to describe compatibility.

Compatibility is your responsibility

Bassurito requires Ableton Live 12 with Max 9 (Max for Live). These are third-party products sold separately. They are not included.

Please check that your setup meets the requirements before buying. Try the free browser demo and watch the video first. We can’t guarantee Bassurito will work with future versions of Live or Max, or with every computer, plugin or operating system.

No warranty

To the fullest extent the law allows, Bassurito and the website are provided “as is” and “as available”, without warranties of any kind. This includes implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the product will be error-free or uninterrupted.

Some countries don’t allow these exclusions. If you are a consumer, you keep any rights the law gives you that can’t be excluded. Nothing here limits those rights.

Limitation of liability

To the fullest extent the law allows, OAKWYN CORP. is not liable for indirect, incidental, special or consequential losses. This includes lost profits, lost data, lost projects or session files, or loss of goodwill. Our total liability for any claim relating to Bassurito is limited to the amount you paid for it.

We do not exclude liability where the law forbids it. This includes death or personal injury caused by negligence, fraud, or (for EU/UK consumers) breach of your statutory rights.

Always back up your Live sets. A MIDI effect can change clips and project data.

Email discount offer

The email popup offers $20 off Bassurito. The code is shown on screen after you sign up and is applied at Polar checkout.

  • The offer is limited to the first 50 redemptions of the code.
  • One use per person. Valid on a first purchase only.
  • Non-transferable. No cash value. Cannot be exchanged for cash or credit.
  • Cannot be combined with other offers.
  • OAKWYN CORP. may end or change the offer at any time.
  • We may cancel codes used fraudulently or in breach of these rules.

If a refund is ever due on a discounted order (for example, as a legal remedy), it is the amount you actually paid.

Refunds

All sales are final. Bassurito is delivered instantly, so we do not offer refunds or returns. Please check compatibility and try the free demo before buying.

This does not affect your statutory rights. If Bassurito is defective or doesn’t work as described, we will fix it or provide a remedy as the law requires. Full details: Refund Policy.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, and applicable US federal law, without regard to conflict-of-law rules.

Any dispute that is not resolved by arbitration under the clause below will be heard exclusively in the state and federal courts located in Volusia County, Florida. You and we consent to those courts’ jurisdiction.

Arbitration and class-action waiver — please read carefully

Except for (a) claims that qualify for small-claims court and (b) claims for injunctive or other equitable relief relating to intellectual property, any dispute, claim or controversy arising out of or relating to these Terms, Bassurito or the website will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be seated in Volusia County, Florida.

You and we waive any right to a jury trial and any right to bring or take part in a class, collective or representative action. Claims may be brought only on an individual basis.

30-day opt-out: you may opt out of this arbitration clause by emailing support@bassurito.com within 30 days of your first purchase. Include your name, the email used for your order, and a clear statement that you opt out of arbitration. If you opt out, or if this clause is found unenforceable, disputes will be heard in the courts named above.

If you live outside the United States, any mandatory consumer protections of the law where you live still apply.

Before going to court, please contact us. Most problems can be fixed with an email.

Changes to these terms

We may update these Terms. The version that applies to your purchase is the one in force when you bought. We will change the “Last updated” date when we make changes.

If any part of these Terms is found unenforceable, the rest still applies.
